Circuit Judge Winston Kidd enters injunction on HB2

Judge Kidd entered an Order Granting Plaintiffs’ Motion for Injunctive Relief.

Oops.  I originally called it a TRO.  However, as Tom Freeland points out it is an injunction.  That is what I get for typing faster than I think.

  1. This isn’t a TRO, it is an injunction (it can’t be a TRO because it does not have the time of entry, and does not expire within ten days. Also, it describes itself as an injunction).

    It is also pretty darn weird.

  2. Can someone enlighten me as to what Judge Kidd thinks he’s doing here? I know you don’t agree with it, but you were in the courtroom. He can’t really think this statute is vague, he has to know he’s going to get reversed, the politics I would not think are such that this is a smart move. What is going on here?

    My guess and that’s all it is because I wouldn’t suppose to know exactly what any judge is thinking:

    Judge Kidd doesn’t agree with unregulated open carry and thinks open carry was an unintended consequence of HB2 defining the term “concealed.” Therefore, he finds HB2 unconstitutionally vague because it allows an unintended consequence.

    The issue comes down to what I previously said about the plaintiffs. It isn’t that the law is vague and they can’t understand HB2. They know exactly what it allows and simply disagree with it.

    He is making his supporters happy, secure in the knowledge he will get reversed regardless. The man plainly has never been shy of being reversed. That op spanking him for letting Tyrone Lewis lie on the stand went like water off a duck’s back.

    Question: should 2/3 of the MSSC be able to unseat a judge for doing a poor job? With permanent exclusion from the ballot? Disbenchment, say?
