AG Jim Hood fires back at opponents of open carry (HB2)

House Bill 2 (HB2) was set to take effect today, July 1, 2013.  Last Friday, a group consisting of Hinds County District Attorney Robert Shuler Smith, Hinds County Sheriff Tyrone Lewis, Hinds County Constables Jerry Moore, John Brown, Lawrence Funches and Bennie Buckner along with others filed a motion for a temporary restraining order and injunctive relief to prevent implementation of HB2.

Their motion was filed at roughly 4:45 p.m. on Friday afternoon and a hearing was set before Hinds County Circuit Judge Winston Kidd.  Despite vigorous argument to the contrary by the State of Mississippi, Judge Kidd entered a restraining order at 6:15 p.m. and set the matter for hearing on July 8, 2013.

Today, the State of Mississippi filed a Combined Petition to Vacate a Restraining Order and Emergency Petition for Interlocutory Appeal.  Moving quickly, the Mississippi Supreme Court entered an Order requiring the Respondents to respond by 5:00 p.m. today.

This case will move quick and given the strength of the State of Mississippi’s arguments, I suspect HB2 will prevail.
